Terms of Service

0. Owner identity

These Terms of Service govern the use of the video game "Stormhold TD" and the associated services offered by Stormhold Studios through Google Play and the stormholdstudios.com website. By installing and using the app you accept these terms; if you do not agree, do not install or use the app.

1. Purpose and acceptance

The purpose of these terms is to regulate the conditions under which "Stormhold TD" is offered and used, a tower-defense video game distributed free of charge through Google Play, with optional online features (global leaderboard, cross-device persistence) and future in-app purchases. Acceptance occurs upon installation, first use of the app, or the first transmission of any data to our servers, whichever happens first.

2. License of use

Stormhold Studios grants the user a personal, non-exclusive, non-transferable, free and revocable license to install and use "Stormhold TD" on compatible devices, solely for personal enjoyment of the game. The following is expressly prohibited:

• Modifying, decompiling, reverse-engineering or otherwise tampering with the application code, except within the limits permitted by mandatory law.
• Distributing, selling, renting, sublicensing or transferring copies of the application.
• Removing, modifying or hiding intellectual property notices, trademarks or attribution.
• Using the application for commercial purposes without the owner's prior written authorization.

3. Player account and nick

The online features (global leaderboard, progress persistence) require a player identifier provided by Google Play Games Services and a nick (alias) chosen by the user.

• Minimum age: the user declares to be at least 13 years old when choosing a nick. Users under 13 must not create nicks or use the online functionality without supervision and consent from their legal guardian.
• Nick content: it is prohibited to choose nicks that are offensive, vulgar, racist, sexually explicit, that impersonate third parties or that infringe intellectual or industrial property rights. Stormhold Studios reserves the right to unilaterally remove nicks that violate these rules.
• Sole responsibility: the user is solely responsible for the nick they choose and for the use they make of their player account.

4. Rules of conduct

By using "Stormhold TD" the user undertakes to:

• Not use external tools, mods, scripts, bots or any other mechanism intended to gain undue advantages (extra coins, stars or leaderboard ranking) without having earned them through normal gameplay.
• Not interfere with or attack the server infrastructure (denial-of-service, injections, automated mass requests, etc.).
• Not impersonate other players or attempt to access their accounts or data.
• Not use the nick or any other channel of the game to send unsolicited advertising, spam or inappropriate content.

Breach of these rules may result in the suspension or cancellation of the player account without prior notice, as well as the deletion of their scores and virtual coins. In case of fraud related to real in-app purchases, Stormhold Studios reserves the right to take the appropriate legal action.

5. In-app purchases (future)

Upcoming versions of "Stormhold TD" will incorporate the ability to purchase packs of virtual coins through real in-app purchases. When active, the following conditions will apply:

• Payment gateway: all purchases are processed entirely through Google Play Billing. The user's bank or card data never reaches Stormhold Studios.
• Nature of the product: coins are an in-game virtual currency with no real monetary value outside the game. Once added to the player's account they can be spent or kept, but they cannot be converted back to real money nor transferred to other players.
• Right of withdrawal (EU): in accordance with article 103.m of Royal Legislative Decree 1/2007 (TRLGDCU), the user expressly consents to immediate performance of the contract (delivery of the coins to their account) and acknowledges the loss of the 14-day right of withdrawal once the digital supply has been performed, except in the legally applicable cases.
• Refunds: refund requests are handled through Google Play according to Google's refund policy. Stormhold Studios reverses the corresponding coin deletion as soon as it receives notification of the refund from Google.
• Availability: Stormhold Studios reserves the right to modify the product catalog, its prices and its availability at any time without prior notice. Purchases made before a change respect the conditions in force at the time of purchase.

6. Advertising (future)

Upcoming versions of the game will incorporate optional rewarded ads served through Google AdMob. The user will be able to voluntarily watch a video ad in exchange for a set amount of in-game virtual coins. Ads are not required to complete the game nor to access its main features; they are merely an alternative, optional way to obtain additional coins.

7. Intellectual and industrial property

All elements of "Stormhold TD" (code, graphics, music, sound effects, texts, designs, "Stormhold", "Stormhold Studios", "Lord Storm" and other creative names and elements of the game) are property of Alejandro Martos Gómez or their respective owners and are protected by intellectual and industrial property regulations in force. The user only acquires the license described in section 2; they do not acquire any property rights over these elements.

8. Suspension and cancellation

Stormhold Studios may suspend or cancel access to the online features of the application, in whole or in part, in the following cases:

• Breach of these terms by the user.
• Technical, maintenance or security reasons.
• Business decision or cessation of the service, with reasonable notice when possible.

The user can stop using the service at any time by uninstalling the app and, if they wish, requesting the deletion of their data in accordance with the Privacy Policy.

9. Limitation of liability

The game is offered "as is" in its free version. Within the limits permitted by applicable law, Stormhold Studios will not be liable for:

• Temporary interruptions of the online service due to maintenance, server outage or external attacks.
• Loss of progress caused by user uninstalls, errors on the user's own device, or the user's choice not to sign in with Google Play Games.
• Indirect damages, lost profits, or unforeseeable damages arising from the use or inability to use the game.

The above does not exclude or limit liability for willful misconduct, gross negligence, nor the mandatory consumer rights recognized by applicable law.

10. Modification of these terms

Stormhold Studios may modify these terms to reflect changes in the service, new features (ads, IAP, etc.) or by legal requirement. The "Last updated" date at the top indicates the date of the version in force. Substantial changes will be notified within the game itself with reasonable advance notice. Continued use after the entry into force of the new version implies acceptance of the new terms.

11. Applicable law and jurisdiction

These terms are governed by Spanish law. For the resolution of any dispute arising from the application or the service, the parties submit to the courts of the owner's domicile (Málaga, Spain), except where mandatory law assigns exclusive jurisdiction to the courts of the consumer's domicile, in which case the latter rule shall prevail. Consumers residing in the EU may resort to the European Commission's online dispute resolution platform.
